jointly and severallyの意味
"jointly"とは、繋ぐという意味合いがありますので、複数の者を包括して表示する場合に使用します。
例えば、債務者が複数いるときには、共同での責任ということになります。
また、severallyとは、分けるという意味合いがありますので、複数の者を分割して考える場合に使用されます。
例えば、"jointly and severally"で連帯債務であることを表示します。
上記二つの違いは、severallyにおいては、個別的に責任を追及できるということにあります。
なお、下記例文②のjointly and severally liable to the Borrower"という表現は、保証人に対しても全額請求できることを意味することにすぎず、日本の民法でいう連帯保証人(催告の抗弁権および検索の抗弁椛を有しない)とは同一の意味にならないことに注意してください。
