英文契約書の日付の表記/期間の表記をわかりやすく解説します
英米法での「日付の表記」の仕方
英文契約書は、英米法にその基礎を置く契約書ですので、日付の表記についても、英米式に準じた方法によらなければなりません。
日本の表記の仕方とは、異なるのでしっかり確認する必要があります。
2015年l0月12日 の表現には、以下の方法があります。
数字だけで表現する場合
(a)2015/l0/12
(b)2015/12/l0

「期間」の計算方法
日本での期間の計算方法
日本での期間の計算方法は、民法に根拠があります。
そこでは、初日不算入という原則が採られているので、基本的には指定された日付の次の日から数えていくことになります。
１４０条には例外的な場合も規定されていますが、ほとんど使われることはありませんので、あまり気にする必要はないかと思われます。
英文契約書上の期間計算
そして、英文契約書上の期間計算においても、初日不算入の原則が妥当しますので、基本的には日本と同じということになります。
但し、日本の例外規定がないので、常時、初日不算入ということになります。

第139条 時間によって期間を定めたときは、その期間は、即時から起算する。
第140 条 日、週、月又は年によって期間を定めたときは、期間の初日は、算入しない。ただし、その期間が午前零時から始まるときは、この限りでない。
様々な日付の表記/期間の表記の仕方
■（1）「～その日に」
その日を表すには、"on"が使われます。
◆英語の例文・書き方
①This AGREEMENT is made and entered into as of October 1,2015 by and between ABC CORPORATION and XYZ COMPANY.
②ABC shall deliver the Products to XYZ on December 25,2015.
■日本語例文・読み方
①本契約は、2015年10月1日に、ABCコーポレーションとXYZカンパニ ーとの間で締結された。
②ABCは、XYZに対し、2015年12月25日に本製品を引き渡す。
■（2）「～の後、～から」
特定の日より、前後を表す場合には、"from"，"after"が使われます。
これらの語を使用する場合は、inclusive,including"(その日を含む) や "exclusive, excluding"(その日を含まない)を併用するか、その日を含む場 合は、代わりに"on and after"，"commencing on/with"，"starting on"な どの語を使用するほうが意味が明確になります。
◆英語の例文・書き方
■2015年l0月1日から60日間 (l0月1日を含まない場合)：
for the period of sixty (60) days from/after October 1,2015 (excluding)
■2015年l0月1日から60日間 (l0月1日を含む場合)：
(1)for the period of sixty (60) days from/after October1.2015 (inclusiive)
(2)for the period of sixty (60) days on and after October1,2015
(3)for the period of sixty (60) days commencing on/with October 1,2015
(4)for the period of sixty (60) days starting on October 1,2015
◆（3）「～その日までに」
期間を限定して、その日までとする場合には、"by"や"before"を使用します。
◆英語の例文・書き方
ABC shall deliver the Products to XYZ on or before December 25,2015.
◆訳例
ABCは、XYZに対し、2015年12月25日までに本製品を引き渡す。
◆（4）「～その日までは」
有効な期間を表示するためには、"till/until and including"を使用し ます。
◆英語の例文・書き方
ABC has an option right to purchase the Products till/until and including March 31,1998.
◆日本語例文・読み方
ABCは、1998年3月31日までは製品を購入する選択権を有する。
◆（5）「～以内の期間/～を超えない期間/～未満の期間」
「以内」には"within (the period of)"、「超えない期間」には"within the period of not exceeding"、「未満の期問」には"within the period less than"をそれぞれ使用します。
◆英語の例文・書き方
30日以内:within thirty (30) days
30日を超えない期間:within the period not exceeding thirty (30)days
30日未満の期間内:within the period less than thirty (30) days
◆（6）「以前・以後」
「以前」も「以後」も、その数字を含みますので、「以前」には"on or before"、「以後」には"on and after"を使用します。
◆英語の例文・書き方
2015年l0月1日以前： on or before October1,2015
2015年l0月1日以後： on and after October1,2015
◆（7）「…から～まで」
"from...to"，"through"を使用します。
◆英語の例文・書き方
4月1日から5月31日まで(双方の日付を含む場合):
(1)from April 1 to May 31. both inclusive
(2)April 1 through May 31. both inclusive
(3)for the period between April1 and May 31. both inclusive
(4)for the period from April 1 through May 31. both inclusive
(5)for the period commencing on/with April1 and ending on May31
