英米法での「日付の表記」の仕方
英文契約書は、英米法にその基礎を置く契約書ですので、日付の表記についても、英米式に準じた方法によらなければなりません。
日本の表記の仕方とは、異なるのでしっかり確認する必要があります。
2015年l0月12日 の表現には、以下の方法があります。
数字だけで表現する場合
(a)2015/l0/12（日本式）
(b)2015/12/l0
(c)l0/12/2015（米国式）
(d)12/10/2015（英国式）

「期間」の正しい計算方法
契約実務では、「期間をどこから数えるか」が誤解を生みやすいポイントです。
日本法と英文契約書では基本ルールが共通しているため、一度理解しておけば安心して使えます。
日本での期間の計算方法
● 基本ルール：初日不算入
日本の期間計算は民法に基づき、初日は数えず翌日から起算します。
例：「10日以内に通知する」→ 指定日の翌日を1日目として数える。
期間が午前0時から始まる場合のみ、初日を算入します。
ただし、実務で使われることはほとんどありません。
英文契約書上の期間計算
英文契約書でも、初日不算入（the day of the act is excluded）が原則です。
そのため、日本法と同じ考え方で処理して問題ありません。
● 日本法との違い日本のような例外規定がないため、常に初日不算入で処理されます。
様々な日付の表記/期間の表記の仕方
■（1）「～その日に」
日付を特定する場合は、on + 日付 を使います。
◆英語の例文・書き方ABC shall deliver the Products to XYZ on December 25,2015.
■日本語例文・読み方ABCは、XYZに対し、2015年12月25日に本製品を引き渡す。
■（2）「～の後、～から」
特定の日を基準に「その後」「その日から」を表す場合、英文契約書では from または after を使用します。
ただし、これらだけでは「その日を含むか」が曖昧になるため、契約書では明確化のための語を併用します。
from / after を使う場合は、inclusive / including（含む）、 exclusive / excluding（含まない） を併用して明確にします。
また、日付を含む場合は、次の表現を使うとより誤解がありません。
on and after

◆英語の例文・書き方■2015年l0月1日から60日間 (l0月1日を含まない場合)：
for the period of sixty (60) days from/after October 1,2015 (excluding)
■2015年l0月1日から60日間 (l0月1日を含む場合)：
(1)for the period of sixty (60) days from/after October1.2015 (inclusiive)
(2)for the period of sixty (60) days on and after October1,2015
(3)for the period of sixty (60) days commencing on/with October 1,2015
(4)for the period of sixty (60) days starting on October 1,2015
◆（3）「～その日までに」
期間を限定して、その日までとする場合には、"by"や"before"を使用します。
◆英語の例文・書き方ABC shall deliver the Products to XYZ on or before December 25,2015.
◆日本語例文・読み方ABCは、XYZに対し、2015年12月25日までに本製品を引き渡す。
◆（4）「～その日までは」
有効な期間を表示するためには、"till/until and including"を使用し ます。
◆英語の例文・書き方ABC has an option right to purchase the Products till/until and including March 31,1998.
◆日本語例文・読み方ABCは、1998年3月31日までは製品を購入する選択権を有する。
◆（5）「～以内の期間/～を超えない期間/～未満の期間」
「以内」には"within (the period of)"、「超えない期間」には"within the period of not exceeding"、「未満の期問」には"within the period less than"をそれぞれ使用します。
◆英語の例文・書き方30日以内:within thirty (30) days
30日を超えない期間:within the period not exceeding thirty (30)days
30日未満の期間内:within the period less than thirty (30) days
◆（6）「以前・以後」
「以前」も「以後」も、その数字を含みますので、「以前」には"on or before"、「以後」には"on and after"を使用します。
◆英語の例文・書き方2015年l0月1日以前： on or before October1,2015
2015年l0月1日以後： on and after October1,2015
◆（7）「…から～まで」
"from...to"，"through"を使用します。
◆英語の例文・書き方4月1日から5月31日まで(双方の日付を含む場合):
(1)from April 1 to May 31. both inclusive
(2)April 1 through May 31. both inclusive
(3)for the period between April1 and May 31. both inclusive
(4)for the period from April 1 through May 31. both inclusive
(5)for the period commencing on/with April1 and ending on May31
(6)from April 1 (inclusive) to May 31 (inclusive)
